WHEREAS, the Town Council of the Town of Vail believes that it will be for the benefit of the health, safety and welfare of the residents of the Town of Vail if the minimum lot size in the residential (R) zone district were changed from 17,500 square feet to 1.5,000 square feet as such a change will create uniformity in the lot size for the R and R P/S zone districts and make minimum lot criteria in the R zone district consistent with the density control section of that district. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, A5 FOLLOWS: Section 1. Section 18.12.050 of the Municipal Code of the Town of Vail is hereby repealed and reenacted as follows: 18.12.050. Lot Area and Site Dimensions. The minimum lot or site area sha11 be 15,000 square feet of buildable site area. Each siiie shall have a minimum frontage of thirty (30) feet. Each site shall be of a size and shape of enclosing a square area eighty (80) feet on each side within its boundaries. Section 2. If any part, section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decisions sha11 not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, sub-section, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, sub-sections, sentences, clauses, or phrases be declared invalid. . ! ~ Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section ~. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereaf, any prosecution commended, nor any other action or proceeding has commended under or by virtue of the provisions repealed or repealed and superceded unless expressly stated herein.
