WHEREAS, the following portions of Columbine Drive, bordering on Lots 20-6, and 18, Bighorn Subdivision, Amended Plat, Town of Vail, County of Eagle, State of Colorado, have never been necessary for the public use and benefit, and the owners of the abutting lots and lands desire to improve said streets hereinafter described and place the same an the tax rolls of the Town, and the Town Council of the Town of Vail, ~, having determined that such use will benefit the public +~; interest; ~~ ,µ NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VATL: Section 1. For and in consideration of $1.00 as good and valuable consideration the Town hereby vacates all its interest in two parcels of land being a portion of Columbine Drive, Bighorn Subdivision, Town of Vail, Colorado. Said parcels being more particularly described as follows : ~ A portion of the right-of-way of Columbine Drive adjacent to Lot 20-6, A Resubdivision of Lot 20, Bighorn Subdivision, Amended Plat, a subdivision recorded in the office of the Eagle County, Colorado, Clerk and Recorder, said portion being more particularly described as follows. Beginning at the northwest corner of said Lot 20-6, thence along the extension to the north of the westerly line of said Lot 20-6, N 37°39'30" 34.04 feet; thence 16.08 feet along the arc of a curve to the left having a radius of 108.18 feet, a central angle of 8°31'00" and a chord which bears 5 80°11'30" E 16.06 feet; thence 84°27'00" E 40.25 feet to the northerly line of said Lot 20--6, thence along said northerly line 91.63 feet along the arc of a curve to the right having a radius of 50.00 feet, a central angle of 105°00'00", and a chord which bears 5 75°09'30" W 79.34 feet to the point of beginning, containing 1,878 square feet or 0.043 acres, more or Less. A portion of the right-of-way of Columbine Drive adjacent to Lot 18, Bighorn Subdivision, a subdivision recorded in the office of the Eagle County, Colorado, Clerk and Recorder, said portion being more particularly described as follows: Beginning at the northeast corner of said Lot 18, thence along the extension to the north of the east line of said Lot 18, N 37°39'30" E 34.04 feet; thence 44.54 feet along the arc of a curve to the right having a radius of 108.18 feet; a central angle of 23°35'30", a chord which bears N 64°08`15" W 44.23 feet to the northerly Line of said Lot 18, thence along said said northerly line 52.36 feet along the arc of a curve to the left having a radius of 50.00 feet, a central angle of 60°00'00", and a chord which bears S 22°20'10" E.S0.00 feet, to the point of beginning, containing 896 square feet or 0.021 acres, more or less. This vacation is expressly conditioned in that the right-of-way hereby vacated shall not be considered or used to increase the allowable GRFA {.gross residential floor area) ar number of unzts an the property receiva.ng the vacated right-of-way. Section 3. That due regard has been given to the irghts and necessities of the public and it is satisfactorily appearing that said portion of the above described street is not necessary to the inhabitants of the Town as an avenue of travel. Section 4. That alI rights of way or easements for the continued use of existing gas, sewer, water or similar pipe lines and appurtenences and for electrical, telephone and similar ],roes and appurtenances and far any other rights of way or easements be reserved pursuant to the provisions of Section 93--2--3~2, C.R.S. Section 5. That Alvin R. B. Knoblock, Kathleen M. Knoblock and John B. Shattuck are the owners of the property abutting said street, being the parties requesting this vacation and they agree to pay all costs incurred with the preparation and publication of this ordinance and said sum shall be paid ~o the Town Clerk prior to the Ordinance's adoption.
