HomeMy WebLinkAbout1981-44 Imposing a One-Half of One Per Cent Tax on the Total Valuation of All Construction Work for Which a Building Permit is Issued for the Purpose of Street Repair1 r _~, r s'V3 • ORDINANCE #~~ {Series of 1981) AN ORDINANCE IMPOSING A ONE--HALT'' OF ONE PER CENT TAX ON THE TOTAL VALUATION OF ALL CONSTRUCTION WORK FOR WHICH A BUILDING PERMIT IS ISSUED FOR THE PURPOSE OF STREET REPAIR; SPECIT'Y' EXEI4IPTIONS, COLLECTION AND ADMINISTRATION PROCEDURES, VIOLATTUNS, AND A TERMINATION DATE OF DECEMBER 31, 1987; AND, SETTING FORTH DETAILS IN RELATION THERETO. WHEREAS, the Town Council has determined that construction activities within the Town has created and will continue to create unusual demands on the City streets and right-of-ways; and WHEREAS, the general taxpayers of the Town should not be required to pay the entire cast of such extraordinary demands; and WHEREAS, the Town Council is of the opinion that a tax should be imposed upon building pexmit fees, with certain exemptions, to assist in paying the cost of repair and maintenance of the city streets and ways; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. The Vail Municipal Code is amended by the addition of a new Chaptex 3.50 to be entitled "Street Repair Tax", to read as follows: STREET REPAIR TAX 3.50.010 -- Purpose Construction which requires the use of large vehicles for construction, delivery, or other purposes, creates extra- ordinary demands on town services, primarily the streets and pub- lic ways that are required for the travel of such vehicles. The construction vehicles, loads and the types of machinery using the public ways cause damage thereto, which creates accelerated deterioration to the public streets. The repair and maintenance of the damage and deterioration caused by construction places an unnecessary burden on the general taxpayer. No building permit shall be issued until the tax is~paid or an exemption is granted. S.5D.040 - Exemptions Permits for the following construction pro,~ects shall be exempt from the tax imposed in 3.50.020 above: (a) A~permit for which the total value of all construction work is less than $50,000.00, provided that the chief building official determa.nes that the construction work for which the permit is issued shall not require (a) the operation of a vehicle on the public streets or ways that exceeds 10,000 pounds gross vehicle Weight, or, (b) other vehicles or use of the public ways or streets that would cause damage or excessive wear and tear to the public right-of-way. _ ....... „ ,. (fit) A permit for any construction for or on behalf of the United States Government, State of Colorado, ar its institu- tions, or its political subdivisions in their governmental capa- city, only, or by religious or charitable corporations in. the can-- duct of their regular religious or charitable functions. 3.50.05(? -- exemption certificate Tf a permit is determined to be exempt, said permit shall not be issued until a Certificate of Exemption is issued and signed by the Town Manager. 3.50.050 -- Collection and administration The collection and administration of this street repair tax shall be performed by the Town Manager. The Town Manager is authorized to promulgate such forms or additional rules and regu- lotions as may be necessary for the proper administration enforce- meet of this Chapter. 3.50.070 -- Violations -- penalty {a) Tt shall be a violation of.this chapter for any person subject to the tax levied herein to refuse to make any pay- ment or return provided to be made, or to make any f alse or fraud-- ulent statements, re'curns or declarations, or any false statements and any application for a building permit, or to fail or refuse to make payment to the director of finance of any tax due the City, or in any manner, to evade the payment of the tax, or any part thereof, imposed by this Chapter, or far any person to fail, or refuse to pay such tax or evade the payment thereof, or to aid or abet in any attempt to evade the payment of the tax imposed here-- xn. Any corporation, partnership, association, or person making a false statement relative to this tax, shall have violated this Chapter, and shall be subject to prosecution and the imposition of penalties as provided by Iaw. (b) Any person, corporation, partnership, or associa- Lion who shall violate any of the provisions of this Chapter shall be guilty of a violation hereof, and shall be puj~ished by a fine °' - - ~ ~.. .. .. ' not to exceed $499.00, or irnprisanment not to exceed 90 days, or both such fine and imprisonment. 3.50.084 -~ Termination date 'phis Chapter and the farms and provisions hereof shall terminate on December 31, 1987, unless expressly extended by the Town Council by Ordinance. Section 2. Severability. If any part or parts of this Ordinance are for any rea- son held to be invalid, such decision shall not effect the valid- ity of the remaining portions of this Ordinance, The Town Council hereby declares that a.t would have passed this Ordinance and each section, subsection, sentence, clause, or phrase thereof, irres- pective of the fact that anyone or mare sections, subsections, sentences, clauses ar phrases may be declared invalid. Section 3. The Town Council finds that this Ordinance is necessary for the preservation of the public health, safety and welfare, ..
