HomeMy WebLinkAbout1982-17 Adopting by Reference the Uniform Building Code, 1982 Edition and All Appendix Chapters Thereto, Excepting Appendix Chapter 12,1 • • • ORDINANCE # 17 Seriesof 1982 AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1982 EDITION, AND ALL APPENDIX CHAPTERS THERETO, EXCEPTING APPENDIX CHAPTER 12; THE UNIFORM MECHANICAL CODE, 1982 EDITION AND ALL APPENDIX CHAPTERS THERETO; THE UNIFORM FIRE CODE, 1982 ADDITION, AND ALL APPENDIX CHAPTERS THERETO; THE NATIONAL ELECTRICAL CODE, 1981 EDITION, AND ALL APPENDIX CHAPTERS THERETO; THE UNIFORM CODE FOR THE ABATE- MENT OF DANGEROUS BUILDINGS, 1982 EDITION, AND APPENDIX CHAPTERS THERETO; THE UNIFORM BUILDING CODES STANDARDS, 1982 EDITION, AND THE UNIFORM FIRE CODE STANDARDS, 1982 EDITION; SETTING FORTH AN AMENDMENT TO THE UNIFORM BUILDING CODE; PRO- VIDING THAT SAID CODES AND AMENDMENTS BE AVAILABLE FOR INSPECTION AT THE OFFICE OF THE TOWN CLERK, TOWN OF VAIL; DESIGNATING A PUBLIC HEARING THEREON; AND SETTING FORTH DETAILS IN RELATION TO THE FORE- GOING. WHEREAS, the Charter of the Town of Vail and the Statutes of the State of Colorado provide that standard codes may be adopted by reference with amendments; and WHEREAS, the Town of Vail adopted by reference the 1979 editions of the Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, and the Uniform Building Code Standards; and WHEREAS, it is the opinion of the Town Council that the public health, safety and welfare would be served by the adoption of the 1982 editions of the Uniform Building Code, the Uniform Mechanical Code, the Uniform Plumbing Code and the Uniform Building Code Standards by reference as well as the adoption of the 1982 editions of the Uniform Fire Code, the Uniform Fire Code Standards and the Uniform Code for the abatement of dangerous buildings and the 1981 edition of the National Electrical Code; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO THAT: Section 1. (a) The 1982 edition of the Uniform Building Code and all appendix chapters thereto, excepting Appendix Chapter 12, is hereby adopted by reference. The Uniform Building Code, 1982 edition, is published by the International Conference of Building Officials, 5360 South Workmen Mill Road, Whittier, CA 90601. • • a -2- (b) The Uniform Fire Code, 1982 edition, and all appendix chapters thereto, is hereby adopted by reference. The Uniform Fire Code, 1982 edition, is published by the International Conference of Building Officials and the Western Fire Chiefs' Association, 5360 South Workmen Mill Road, Whittier, CA 90601. (c) The Uniform Mechanical Code, 1982 edition, and all appendix chapters thereto, is hereby adopted by reference. The Uniform Mechanical Code, 1982 edition, is published by the Inter- national Conference of Building Officials, 5360 South Workmen Mill Road, Whittier, CA 90601. (d) The Uniform Plumbing Code, 1982 edition and all appendix chapters thereto, is hereby adopted by reference. The Uniform Plumbing Code is published by the international Conference of Building Officials, 5360 South Workmen Mill Road, Whittier, CA 90601. (e) The Uniform Code for the Abatement of Dangerous Buildings, 1982 edition, and all appendix chapters thereto, is hereby adopted by reference. The Uniform Code for the Abatement of Dangerous Buildings, 1982 edition, is published by the Inter- national Conference of Building Officials, 5360 South Workmen Mill Road, Whittier, CA 90601. (f) The Uniform Building Code Standards, 1982 edition, and all appendix chapters thereto, and the Uniform Fire Code Standards, 1982 edition, and all appendix chapters thereto, are hereby adopted by reference. Both codes are published by the International Conference of Building Officials, 5360 South Workmen Mill Road, Whittier, CA 90601. (g) The National Electrical Code, 1981 edition, and all appendix chapters thereto, is hereby adopted by reference. The National Electric Code, 1981 edition, is published by the National Fire Protection Association, 470 Atlantic Avenue, Boston, MA 02210. • • i -3- Section 2. The following amendments are made to the Uniform Building Code, 1982 edition. A. Section 202 (d) Stop Work Orders is amended to provide that the building official may order work stopped whenever work is being done contrary to the provisions of the Building Code, the Zoning Ordinances of the Town of Vail, the subdivision ordinances of the Town of Vail, and the nuisance ordinances of the Town of Vail. Section 202 (d) Stop Orders as amended reads as follows: "Whenever any work is being done contrary to the provisions of this code, the zoning ordinances of the Town of Vail, and the nuisance ordinances of the Town of Vail, the building official may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be done, and any such person shall forthwith stop such work until authorized by the building official to proceed with the work. B. Section 304 is repealed and re-enacted to read as follows: Section 304(a) BUILDING PERMIT FEES A fee for each Building Permit shall be paid to the Building Officials as set forth in Table No. 3-A. Such Building Permit Fee schedule shall be available from the Building Official and shall be based on the total value of all construction work for which the permit is issued, as well as all finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire extinguishing systems, and any other permanent work or permanent equipment. The determination of value or valuation shall be made by the Building Official and shall be based on average typical con- struction costs in the Town of Vail for the type of proposed construction or actual contract amount, whichever is higher. Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein. TOTAL VALUATION $1.00 to $500.00 $501.00 to $2,000.00 FEE $10.00 $10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00. $2,001.00 to $25,000.00 $25,001.00 to $50,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00. $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00. • • -~ • $50,001.00 to $100,000.00 $283,00 for the first $50,000.00 plus $3,00 for each additional $1,000.00 or fraction thereof, to and including $100.000.00. $100,001.00 and up $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof. C. Section 304(b) PLAN CHECK FEES Plan Check fees shall be charged as a separate fee or shall be included in the Building Permit Fee, at the discretion of the Town Council of the Town of Vail. If such Plan Check Fees are not included in the Building Permit Fee, then said Plan Check Fees for the buildings of R-3 and M Occupancies shall be one-half (~) of the Building Permit Fees. Plan Check Fees for all other buildings shall be 65% of the Building Permit Fees as set forth by the Town Counci 1. D. Section 304(f) CLEAN-UP DEPOSITS All construction with a valuation in excess of $2,000.00 shall require a Clean-Up Deposit as set forth in Table No. 3-B, ex- cept roofing, as amended. The Clean-Up Deposit shall be paid to the Building Official with the Building Permit Fee. The job site shall be kept clean and orderly at all times. If necessary the Town of Vail, Colorado, will clean the job site and put it in order and deduct a reasonable sum for such services from the deposit. A refund of the deposit or the remaining balance thereof, if any, shall be made after all appropriate clean-up work has been completed and approved by the Building Official. If such Clean-Up Deposit is depleted totally or partially, construction shall be stopped until the Clean-Up Deposit is restored to the original amount. E. Section 3. Copies of all the codes adopted by this ordinance and all amendments thereto shall be available for inspection at the office of the Town Clerk of the Town of Vail, Colorado. Section 4. Upon the adoption of this ordinance, Chapters 15.04, 15.12, 15.16, 15.20, and 15.24 of the Vail Municipal Code shall be repealed. Section 5. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. ... ~ . • -5- Section 6. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed five hundred dollars ($500.00) or by imprisonment not to exceed ninety (90) days of both unless otherwise stated by an exception of the code. Each and everyday that any violation continues shall be considered a separate violation. Section 7. The repeal or the repeal and reenactment of any provision of the Vail Municial Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. Section 8. There shall be a public hearing for the consideration of the adoption of the code set forth in this ordinance, by reference, on the 6th day of July, 1982, at 7:30 p.m. in the Town Council Chambers, Municipal Building, Vail, Colorado. The Town Clerk shall have notice of that public hearing published in the Vail Trail on two occasions, the first not less than fifteen (15) days prior to the public hearing and the second not less than eight (8) days prior to the public hearing. Section 9. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof.
