HomeMy WebLinkAbout1982-26 Amending Certain Sections of Chapter 18.52: Off-street Parking and Loading of the Vail Municipal Code to Clarify Wording; Provide for Compact Cars, Remove Reference to Driveway Grades and Heating Systems and others~ • ~ ORDINANCE N0. 26 Series of 1982 AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 18.52: OFF-STREET PARKING AND LOADING, OF THE VAIL MUNICIPAL CODE TO CLARIFY WORDING, PROVIDE FOR COMPACT CARS, REMOVE REFERENCE TO DRIVEWAY GRADES AND HEATING SYSTEf~1S, INCREASE THE MINIMUM SIZE OF A PARKING LOT BEFORE INTERIOR LANDSCAPING IS REQUIRED, REVISE PARKING REQUIREh1El'dTS FOR MOST USES AND CLARIFYING THE DEFINITION OF FLOOR AREA IN SECTION 18,04,120 WHEREAS, Chapter 18.52 of the Vail Municipal Code entitled "Off-Street Parking and Loading" has, for the most part been in existence as is for 9 years and is in need of updating and clarifying in various sections; and WHEREAS, certain uses in the Town have shown the need for more parking than is presently required and a study of other municipalities' requirements reinforce this experience; and WHEREAS, the Planning and Environmental Commission has recommended approval of the revisions contained herein; and WHEREAS, the Town Council considers that it is in the interests of the public health, safety and welfare to adopt this ordinance, NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWIV OF VAIL, COLORHUO, THAT: SECTION 1 Section 18.52.010 "Purpose" of the Vail Municipal Code is amended as follows: In order to alleviate progressively or to prevent traffic congestion and shortage of on-street parking areas, off-street parking and loading facilities shall be provided incidental to new structures, enlargements of existing structures or a conversion to a new use which requires additional parking under this chapter. The number of parking spaces and loading berths prescribed in this chapter shall be in proportion to the need for such facilities created by the particular type of use. Off-street parking and loading areas are to be designed, maintained and operated in a manner that will ensure their usefulness, protect the public safety, and, where appropriate, insulate surrounding land uses from their impact. In certain districts, all or a por~cion of the parking spaces prescribed by 'phis chapter are required to be within the main puilding in order to avoid or to minimize the adverse visual impact of large concentrations of exposed parking and of separate garage or carport structures. SECTION 2 Section 18.52.020 "Applicability" shall be amended to read as follows: "Off-street parking and loading space shall be provided for any new ouilding, for any addition or enlargement of an existing building or for any conversion of uses which requires additional parking under this section. •_ • SECTION 3 Section 18.52.030 "Existing Facilities" shall be amended as follows: Off-street parking and loading facilities used for off-street parr<ing and loading on the effective date of the ordinance codified in this title shall not be reduced in capacity to less than the nur~rber oi~ spaces prescribed ir7 this chapter, or reduced in area or number to less than the minimum standards prescribed in this chapter. SECTION 4 Section 18.52.080 (B), (C) and (F) Parking--Standards shall be arnerrded as follows: B, Size of Space. Each off-street parking space shall be not less than nine feet wide by nineteen feet long, and if enclosed and/or covered, riot less than seven feet high. An exception to the size of space shall be allowed for compact spaces in lots witYr more than 15 spaces. In this case, up to 25 percent of the spaces may be eight by sixteen and the cor~ipact spaces shall be clearly marked as such. C. Accessways. Unobstructed and direct accessways not less than ten feet nor more than twenty feet in width shall be provided from off-street parking to a street or alley. F. Landscaping. Not less than ten percent of the interior surface area of unenclosed off-street parking areas containing 15 or more parking spaces shall be devoted to landscaping. In addition, landscaped borders not less than ten feet in depth shall be provided at all edges of parking lots containing more than 15 parking spaces. Landscaped borders not less than fifteen feet in depth shall be provided at all edges of parking lots containing more than thirty parking spaces. A landscaped berm, wall or fence not less than four feet in height of the same architectural style as the building may be substituted for the landscaped border, subject to Design Review approval. SECTION 5 Section 18.52.090 Loading--Standards (A) shall be amended as follows. A. Location. All off-street loading berths shall be located on the same lot as the use served, but not in the required front set-back. Off-stree~c loading berths shall be provided in addition to required off-street parking and shall not be located within accessways. • ~ ~ SECTION 6 Section 18.52.100 Parking--Requirements schedule shall ae amended as follows. Off-street parking requirements shall be determined in accordance with the following schedule: USE I Dwelling Unit III. Other Uses A. Medical and dental offices B. Other professional and business off ices C. Banks and financial institutions (i.e, savings and loan) D. Retail stores, personal services and repair shops E. Eating and drinking establishments F. Theaters, meeting rooms, convention facilities G. Quick-service food/ convenience stores H. Recreational facilities, public or private I. Hospitals J. Warehousing PARKING REQUIREMENT If gross residential floor area is 500 square feet or less: 1 .5 spaces per dwell ir~g unit If gross residential floor area is over 500 square feet up to 2,000 square feet: 2 spaces per dwelling unit If gross residential floor area is 2,000 square feet or more per dwelling unit: 2.5 spaces per dwelling ur11t 1.0 space per each 200 square feet of net floor area 1.0 space per each 250 square feet of net floor area 1.0 space per each 200 square feet of net floor area 1.0 space per each 300 square feet of net floor area 1.0 space per each 8 seats, based on seating capacity or building code occupancy standards, whichever is more restrictive 1.0 space per each 8 seats, based o.1 seating capacity or building occupancy standards, whichever is more restrictive 1.0 space per each 200 square feet of net floor area for the first 1000 square feet of net floor area: 1.U space per 300 square feet for rlet floor area above 1000 square feet. Parking shall be required. Amount to be determined by the planning commission. 1.0 space per patient bed plus 1 space per 150 square feet of net floor area 1.0 space per each 100 square feet of net floor area. ,, SECTION 7 18.04.120 Delete SECTION 8 18.04.135 Floor Area, Net "Net Floor Area'," (used only for calculating parking requirements) is defined as the total) floor area within the enclosing walls of a structure not including the following: 1. Areas specifically designed and used for mechanical 2. Stairways 3. Elevators 4. Common hallways 5. Common lobbies 6. Common restrooms 7. Areas designed and used for parking equipment to operate the building 8. Areas designed and used as storage which do not have direct --- access to an individual office or retail store, not to exceed 5% of, the total proposed net floor area for office and not to exceed 8% of the total proposed net floor area for retail. Common areas are spaces for which all tenants in the building contribute toward the upkeep and maintenance there of and are not used for employee working areas. SECTION 9 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the re- maining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereto regardless of the fact that any one or more parts, sections, subsections, sentences, cruses or phrases may be declared invalid.
