"~ `~`~ ~~ AN ORDINANCE REGULATING THE DISTRIBUTSON OF PRINTED MATTER UPON PUBLIC AND PRIVATE PROPERTY AND PROVIDING DETAILS IN RELATION TIIERETO. WHEREAS, the indiscriminate distribution of printed matter upon residential property is creating wide-spread litter and a serious police problem in that the accumulation of said matter,. ~; is an open invitation to burglary, and WI-IEREAS, the indiscriminate distribution of printed matter both upon ,public and private property is injurious to the public health, safety and welfare of the residents of the Town, NOW, TI~IERET'ORE, BE IT ORDAINED BY THE TOWN COUNCTL OF THE TOWN OI' VAIL, COLORADO: Section 1.. For the purpose of this ordinance, the following terms shall be construed as herein set forth: A. Commercial Handbill. "Commercial handbill" shall mean any printed or written matter any sample ox' device, dodger, circular, leaflet, pamphlet, paper, booklet or any other printed or otherwise reproduced original or copies o:~ any matter of literature: i. Which advertises for sale any merchandise, product, commodity or thing or ii. Wha_ch directs attention to any business or mercantile or commercial establishment, or other activity, for the purpose of either da.rectly or indirectly promoting the interest thereof by sales; or iii. Which directs att,ention,to or advertises any meeting, theatrical per:Cormance, exhibit~n or event of any kind for which a cc?mtniss~.on ~'ee is charged for the purpose of private gain or profit . I3. Non-commercial Handbill. "Non-commercial handbill" shall mean printed or written matter, any sample or device, dodger circular, leaflet, pamphlet, newspaper, magazine, paper, booklet or any other printed or otherwise reproduced ori~;i.nal or copies of any matter of literature not included in the 4s y • ~, aforementioned definitions of a commercial handbill. C. Public property or public place. Public; property or public place shall mean all property owned, operated or controlled by any governmental agency including but not limited to streets, sidewalks, parks, playgrounds, parking lots, , schools, libraries, post office, municipal. transport facilities and other public lands and buildings. H. Private property or private place. Private property or private place shall mean all property not included i.n the aforesaid definition of public property including but not 1imi.ted to vacant land or to any land, building ar other structurre desi~;•ned or used for residential, commercial, business, industrial, institutiona.7. or religious purposes, together with any yards, grounds, walks, driveway, Tench, parch, steps, vestibule, mail. box and other structure appurtenant thereto. Section 2. No person shall throw, distribute, deposit, or place any commercial or non-commercial handbill in or upon any sidewalk, street, public building or structure, public park, school. building or ground, a11ey, utility pole, lamp post, hydrant, bridge, tree, or any other public place within the city. However, the provisions of this section shall not be deemed to prohibit the personal delivery of such matter 'to persons who are willa.ng to accept the same. iVor shall the provisions of this section be deemed to prohibit the posting of handbills on Town of Vail kiosks which have been provided for such purpose or on any other structures specifically designated by the Town for such purpose. Section 3. No person shall. throw or deposit any commercial or non-commercial handbill in or upon,:~any vehicle, However, it shall not f be unlaw:[~uJ_ :in any public place for a person to hand out or distribute without charge to the receiver thereof a commercial or non-commercial handbil]. to the occupant of any vehicle who is willing to accept it. Section 4. No person shall throw, deposit or distribute any commercial or non-commercial handbill upon any private property or place il' requested by anyone thereon not to do so, or if there is placed on said premi:;es in a conspicuous position nea~~ the entrance thereof, a sign bc~tcring the words no advertising, no trespassing, or any si.m'!ar notice indicating in any manner that the occupant of said _~_ privacy disturbed ar have any such handbi7.~ls left upon such premises. Such sign shall not exceed six (6) square inches in size and shall be in accordance with Title 1.6 of the Vail Municipal. Code. Section 5. No person shall throw, deposit or distribute any cammer.cial car non-commercial handbill in or upon private property or place which are inhabited, except by handing or transmitting any such handbill directly to the owner, occupant or other person present or upon such private premises. However, in case of inhabited private premises which are not posted as provided ill this ordinance, such. person, unless requested upon anyone upon the premises not to do sa, may place ar deposit any such, handbill in or upon such inhabited private premises, if such handbill is sa placed or deposited as to secure or prevent such handbill from being blown or drifted about such premises or sidewalks, or streets or othex public places and except that mailboxes may not be so used when so prohibited by :federal postal law or regulations, The provisions of this section shall not apply to a) the distri- butian of mail by the United States nor to newspapers except that news- papers shall be pl-aced on private property in such a manner as to prevent their being carried ar"deposited by the elements upon any street, side- walk or other public place or upon private property, and b) official citations and court processes of the Town of Vail, parking tickets of the Town of Vail, stop work orders or any other official documents issued by the Town of Vail. , Section 6. Any distribution, circulation or delivery of commercial or non--cc}mmercial handbills by means other than as specified in this ordinance shall be deemed littering and is hereby made unlawful. Section 7 if any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not ei~~'ect the validity of the remaining portions of this ordinance; and the Tawn Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 8 . , 1 I j .. -4- welfare of the Town of Vail and the inhabitants thereof. Section 9 The repeal or the repeal and reenactment of any provision of the Vail. Municipal. Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation - that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or „ by virtue of the provision repealed or repealed or reenacted. The.,.: repeal. o.f any provision hereby shall not revive any provision or any,;' ordinance previously repealed or superseded unless expressly stated'` herein.
