AN ORDINANCE DEFINING AN HISTORIC BUILDING FOR THE PURPOSES OF SECTION 104 (f) OF THE UNIFORM BUTLDTNG CODE, 1.982 EDITION; SETTING FORTT-1 A PROCEDURE WHEREBY ONE MAY HAVE A BUILDING OR A STRUCTURE DESIGNATED AS HAVING SPECIAL HISTORICAL OR ARCHITECTURAL SIGNIFICANCE; AND PROVIDING DETAILS IN RELATTON THERETO. W~~EI~EAS, Section 104 (f) of the 1982 edition of the Uniform Building Code Historic Buildings provides that certain work for the preservation ofi a building or structure may be done without conformance to all the requirements of the Uniform Building Code, 1982 edition, under certain circumstances provided that the building or structure has been designated by official action of the Town of Vail as having special historical nr architectural significance; and WHEREAS, the Town Council believes it would benefit the health, safety and welfare of the inhabitants of the Town of Vail if a pro- educe for such designation were established. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCxL OF THE TOWN OF VAIL; Section 1. For the purposes of Section 104 (f) of the 1952 edition of the Uniform Building Code a building or structure within the Town of Vail shall be designated as having special historical or architectural significance if such building or structure meets the following criteria: A. It; has been .in existence for at least fifty (50) years. B. It has importance in the history, architecture, archaeology, or culture oi' the Town of Vail as determined by the Planning and Environ- mental Commission of the Town of Vail. Section 2. Anyone wishing to have a building or structure designated as architecturally or historically significant shall file an applicat~.on with the Planning and Environmental Commission of the Town of Vail, which application. shall be made upon a form provided by i,he mooning administrator which shall contain the following information: ~.. The name and address of the owner or applicant, 2. A ~.egal description, street address or other identifying data conc;ernia~~;~ Lit i ~; t i t c~ . 3. A picture of the building or structure. f ^{~ ' t^ " ,~. structure. 5. ~ ~ -2 -- A statement giving the age of the proposed building or A brief description as to why the applicant considers the building or structure to have historical or architectural significance. 6. Such additional material as a zoning administrator may re- quest or the applicant may submit pertinent to the application and to the findings prereciuisite to the issuance of a designation. Section ~. Upon receipt of an application for the designation of a building or structure as having historical or architectural significance, the Planning and Environmental Commission shall set a date for hearing to determine whether such building or structure shall be designated as historically or archi.tectura~.ly significant. Section d. The criteria the Planning Commission shall use to determine whether to designate a building ox structure as architecturally or historically significant shall include but not limited to the followinK: A. The association of such building or structure which events have made it a significant contribution to the history of the Town of Vail or the surrounding area, the State of Colorado, or the United States. I3. The connection of such property with persons significant in such history. C. Distinctive characteristics of a type, period, method of construction. D. The geographic importance of the property. E. The possibility of important discovery related to pre- history or history. Secti~n.5. Neither the designation of any building or structure as hava.ng his~t:oric or architectural significance pursuant to this ordinance nor the authorization by the building official for repairs, alterations and additions without conformance to the Uniform Building Cc~dt~ pursuant to Section 1.0~ ( f ) thereof , shall not imply that said bui7 ding i;; in ~z safe cond i ~ i {~n , or without hazard. ' • ;,~ -~ ,~. _~_ Sect,i.an 6 If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it vaould have passed this ordinance, and each part, section, subsection, sentence, clause of phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared 9.nvaa_~d. 5ectian 7 The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and we11'are of the Tawn of Vail and the inhabitants thereof . Section 8'q1 The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that; occurred prior to the effective date hereof, any prosecution commenced, noz• any other action or proceeding as commenced under or by virtue of the provision repealed or repealed ox reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein.
