AN ORDINANCE AMENDING SECTION 18.26.040
OF THE VAiL MUNICIPAL CODE TO ADD TO THE
CONDITIONAL USES IN COMMERCIAL CORE II:
COMMERCIAL. STORAGE--WITH CERTAIN RESTRICTIONS

WHEREAS, the Town Council is of the opinion that certain areas in Vail
Lionshead cnu1d, possibly, be suitable far the use of commercial storage if
proper restrictions were included; and
WHEREAS, under a conditional use permit review process each individual
project would receive a detailed study to ensure its compatibility with the
surrounding uses as well as not create other negative impacts; and
WHEREAS, the Planning and Environmental Commission has recommended
to Town Council the adoption of the below amendment;
NOW, THEREFORE, QE IT ORDAINED BY THE TOWN COUNCIL OF TL{E TOWN OF VAIL
THAI-
Section 1.
Section 18.26.040 Conditional Uses - Generally, is hereby amended to
add the following paragraph G to read as follows:
G. Cormiercial Storage - as long as it is at basement level and does
not have any exterior frontage on any public way, street, walkway or mall area,
Section 2.
If any part, section, subsection, sentence, clause or phrase of this ordinance
is for any reason held to be invalid, such decision shall not affect the validity
of the remaining portions of this ordinance; and the Town Council hereby declares
it would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.

necessary and proper for the health, safety and welfare of the Town of Vail and
the inhabitants thereof.
Section ~.
The repeal or the repeal and reenactment of any provision of the Vail Municipal
Code as provided in this ordinance shall not affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action or proceeding as commenced under
or by virtue of the provision repealed or repealed and reenacted. The repeal of
any provision hereby shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
INTRODUCED, READ AND PASSED ON FIRST READING THIS ~~~ day of ///C~~~_ ,

of 1983, at 7:30 p.m. in the Council Chambers of the
Vail Municipal Building, Vail, Colorado.
