AN ORDINANCE AMENDING SECTION 18.36.030
OF THE VAIL MUNICIPAL CODE PROVIDING THAT
PRIVATE HELIPADS BE INCLUDED AS A GONDITIONAL
USE WITHIN THE PUBI_.IC USE Di5TRICT; AND ~.
SETTING FORTH DETAILS RELATING THERETO.

WHEREAS, Preston Ewen d.b.a. Eagle Vail Helicopters has made application in
accordance with Section 18.66.100 of the Vail Municipal Code to amend the Public
Use Zone District to allow private helipads as a conditional use; and
WHEREAS, a public hearing has been held in accordance with the provisions of
Chapter 18.66; and
WHEREAS, the Planning and Environmental Commission has recommended denial of
the proposed amendment; and
WHEREAS, the Town Council is of the opinion that the public health safety and
welfare would be served by amending said code;
NOW THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL,
COLORADO THAT:
Section 1.
The Vail Municipal Code is amended by the addition of a new item ]8.36.030.5
to read as follows:
5. Private helipads
Section 2.
If any part, section, sub-section, sentence, clause or phrase of this ordinance
is for any reason held to be invalid, such decisions shall not affect the validity
of the remaining portions of this ordinance; and the Town Council hereby declares
it would have passed this ordinance, and each part, section, sub_section, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, sub-sections, sentences, clauses, or phrases be declared invalid.

Section 3,
The Town Council hereby finds, determines and declares that this ordinance is
necessary and proper far the health, safety and welfare of the Town of Vail and
the inhabitants thereof.
Section 4.
The repeal or the repeal and reenactment of any provision of the Vail Municipal
Code as provided in this ordinance sha11 not affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action or proceeding as commenced under
or by virtue of the provision repealed or repealed and reenacted. The repeal of
any provision hereby shall not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
INTRODUCED, READ AND PASSED ON FIRST READING THIS 20th day of September
19$3, and a public hearing shall be held on this ordinance on the 4th day
of October 1983, at 7:30 p.m. in the Council Chambers of the
Vail Municipal Building, Vail, Colorado.
