HomeMy WebLinkAbout1983-41 Amending Sections of the Vail Municipal Code 18.24.065 and 18.26.045 Exterior Alterations or Modifications Procedure to Allow Up to 100 Sq Ft of Enclosed Floor Area to be Reviewed at Any Time During the Year' ORDINANCE 41 Series 1983 AN ORDINRNGE AMENDING SECTIONS OF THE UAIL MUNICIPAL CODE 18.24.065 AND 18.26.045 EXTERIOR ALTERATIONS OR MODIFICATIONS PROCEDURE TO ALLOW UP TO 100 SQUARE FEET OF ENCLOSED FLOOR AREA TO RE REVIEWED AT ANY TIME DURING THE YEAR. WHEREAS, the exterior alteration and modification section of the Vail Municipal Code has been in place for three years and needs refinement for small additions of enclosed floor area; and WHEREAS, the small addition of enclosed floor area does not have a significant visual or functional impact on Vail Village ar Vail Lianshead; and WHEREAS, the Planning and Environmental Commission has recommended approval; and WHEREAS, the Tawn Council considers that it is in the interest of the public health, safety and welfare to adopt this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL Ofi THE TOWN OF NAIL THAT: Section 1 Sections 18.24.065 A.S. and 18.26.045 A.5 shall be amended to add: a. {Notwithstanding the forgoing, applications for the alteration of an existing building which add or remove any enclosed floor area of not more than 100 square feet may be submitted at the required time of the month for Planning Commission review. The review procedures shall, in all respects, be the same as that for other applications in accordance with this section. A11 enclosed floor area for an expansion or deletion pursuant to this subparagraph a. shall be physically and structurally a part of an existing or new building and shall not be a free standing structure. A single property owner shall not be permitted more than one submission in accordance with this subpara- graph a in any two year period. A property owner may, however, apply for an expansion greater than l0O square feet in any year in which he submits his application on the May and November dates set forth in paragraph A5, i ' ~ ~~ 5~:~, ion 2. If any part, section, subsection, sentence, clause or phrase ai' this ordinance is for a.ny reason held to be invalid, such decision shall not efi'ect the validity of the remaining portions of this ordinance; and the Tatvn Council hereby declares it would have passed this ordinance, and cacf~ part, section, subsection, sentence, clause ar phrase thereof, rc~~ardless of the facti that any one ar more parts, sections, stl~S(:C:tiallS, sentences, clauses ar phrases by declared invalid. Section 3. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 4. The repeal or the repeal and reenactment of any provision of the Vail Municipal Code as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior tv the effective date hereof, any prosecution commenced, nor any other active or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted.
