AN ORDINANCE AMENDING SECTION
18.36.030 OF THE VAIL MUNICIPAL
CODE TO ADD TO THE CONDITIONAL.
USES IN THE PUBLIC USE DISTRICT:
HAND GUN RANGES.
WHEREAS, the Town Council is of the opinion that certain areas of the Town
of flail could be suitable for the use of a hand gun range if proper restrictions
were included; and ~~
WHEREAS, under a conditional use permit review process each individual project
would receive a detailed study to ensure its compatibility with the surrounding
uses as well as not create other negative impacts, and
WHEREAS, all property zoned public Use District is owned by the Town of Vail;
and
WHEREAS, the Planning and Environmental Commission has recommended to the
Town Council the adoption of the below amendment;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL 0~' THE TOWN OF VAIL THAT:
Section 1
Section 18.36.030 Conditional Uses - Generally, is hereby amended to add
the following Paragraph S to read as follows:
S• Hand gun ranges
Section 2
If any part, section, subsection, sentence, clause or phrase of this ordinance
is far any reason held to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance; and the Town Council
hereby declares it would have passed this ordinance, and each part, section,
subsection, sentence, c'~ause or phrase thereof, regardless of the fact that
any one or more parts, sections, subsections, sentences, clauses or phrases
be declared invalid.

Section &.
The Town Council hereby finds, determines and declares that this ordinance is
necessary and proper for the health, safety and welfare of the Town of Vail and
the inhabitants thereof.
Section b•
The repeal or the repeal and reenactment of any provision of the Vail Municipal
Cade as provided in this ordinance sha11 not affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action ar proceeding as commenced under
or by virtue of the provision repealed ar repealed and reenacted. The repeal ~af
any provision hereby sha11 not revive any provision or any ordinance previously
repealed or superseded unless expressly stated herein.
INTRODUCED, READ AND PASSED ON FIRST READING TFfIS 7th day of February
1984, and a public hearing shall be held on this ordinance on the 2 1st day
of ~~~rna.rv 1984 at 7:30 p.m. in the Council Chambers of the
Vail Municipal Building, Vail, Colorado.
