AN QRDINANCE AMENDING ORDINANCE #30 OE 1977;
CHANGING THE MAXIMUM ALLOWABLE DWELLING UNITS
ON LOT 6, E3LOCK 2, POTATO PATCH, FROM A
MAXIMUM OF 30 UNITS PLUS ONE EMPLOYEE UNIT
TO A MAXIMUM DF 3b UNITS PLUS ONE EMPLOYEE
HOUSING UNIT.
WHEREAS, Ordinance #30 of 1977 zoned Lot b, Black 2, Potato Patch to a
maximum of 30 dwelling units plus one employee dwelling unit; and
WHEREAS, the densty increase is justified due to improvements in the project`s
site planning; and
WHEREAS, the Planning and Environmental Commission has recommended approval
of this amendment; and
WHEREAS, the Town Council is of the opinion that this amendment will protect
the health, safety and welfare of the inhabitants of the Town of Vaij;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL,
COLORADO, THAT:
Section 1.
Exhibit A of Ordinance #30, Series of 1977, fifth paragraph from the top, is
hereby amended to read as follows.
Lot 6, Block 2, Potato Patch shall be zoned Medium Density Multi-Family
(MDMF) with a maximum of 36 units plus one unit which shall be restricted
to er-~ployee housing.
Y '' Section 2.
If any part, section, subsection, sentence, clause or phrase of this ordinance is
for any reason geld to be invalid, such decision shall not affect the validity of
the remaining portions of this ordinance; and the Town Council hereby declares it
would have passed this ordinance, and each part, section, subsection, sentence,
clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.
Section 3.
The Town Council hereby finds, determines and declares that this ordinance is
necessary and proper for the health, safety and welfare of the Town of Vail and
the inhabitants thereof.
Section 4.
The repeal or the repeal and reenactment of any provisions of the Vail Municipal
Code as provided in this ordinance shall riot affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date hereof,
any prosecution commenced, nor any other action or proceeding as commenced under
or by virtue of the provision- repealed or repealed and reenacted. Zhe repeal of
any provision hereby shall not revive any provision or any ordinance previously
repealed ar superseded unless expressly stated herein. ,
INTRODUCED, READ AND PASSED ON FIRST READING THIS day of
1984, and a public hearing shall be held on this ordinance on the day
of 1984 at 7:30 p.m. in the Council Chambers of the Vail
Municipal Building, Vail, Colorado.
