HomeMy WebLinkAbout1985- 9 Amending Section 18.58 of the Vail Municipal Code by the Addition of a New Section 18.58.320 (Supplemental Regulations) Entitled "Satellite Dish Antennas"~• r ORDINANCE NO. 9 Series of 1985 AN ORDINANCE AMENDING SECTION 18.58 OF THE MUNICIPAL CODE OF THE TOWN OF VAIL BY THE ADDITION OF A NEW SECTION 18.58.320 (SUPPLEMENTAL REGULATIONS) ENTITLED "SATELLITE DISH ANTENNAS," REPEALING SECTION 38.54.050 F.3 OF THE DESIGN REVIEW GUIDELINES, AND ENACTING A NEW SECTION 18.54.050.3 H ENTITLED "SATELLITE DISH ANTENNAS" IN THE DESIGN REVIEW GUIDELINES. ~~ 4JHEREAS, the steady growth of the satellite dish industry can be expected to result in increasing numbers af~ satellite dish antennas proposed in the Town of Vail; and WHEREAS, existing zoning regulations and the Design Review Guidelines do not adequately provide far a thorough review of applications for satellite dish antennas; and :JFIEREAS, the Town Council is of the feeling that we need to regulate the installa- tion of satellite dish antennas so as to minimize their visual impact and provide for safe installations. NOW, THEREFORE, QE IT ORDAINED 8Y THE T04lN COUNCIL OF THE TOWPJ OF VAIL AS FOLLOWS: Section 1. Chapter 18.58 of the Municipal Code of the Town of Vail is hereby amended ;,~~ith the addition of a new section, 18.58.320 entitled "Satellite Dish Antennas" to read as follows: 18.58.320 Satellite Dish Antennas A. The purposes of this section are as follows: µl. To protect the health and safety of the inhabitants of the Tawn by setting forth requirements for the installation of satellite dish antennas. 2. To protect and support the aesthetic concerns of the Town of Vail -- a resort community which must remain aesthetically pleasing to visitors to remain economically viable. 3. Ta prr;~ide the protection set forth in the preceding paragraphs 1 and 2 in the least restrictive manner passible. ' ~• - Ord 9/ 19~. B. Definition Far the purpose of this section, the satellite dish antenna shall mean a dish shaped or parabolic shaped reception or transmission antenna which is more than two feet in diameter (including dishes star~_ or temporarily placed for more than one day) far the reception and/or transmission of satellite signals, including, but not limited to television signals,'RM radio signals, Fh1 radio signals, telemetry signals, data communications signals, or any other reception or transmission signals usin<~ free air space as a medium, whether for commercial or private use.. C. Satellite dish antennas shall comply with all the requirements see for•L~ herein. Person or persons wishing to install a satellite dish antenna within the town shall submit an application to the Community Development Department for review. The application shall set forth the following: 1. Completed Design Review Board application farm, 2. Site Plan showing proposed location of the satellite dish antenna 3. Description of the satellite dish antenna {i.e. size, design, materials, etc.) 4. Color sample (if applicable) 5. Landscape plan (if applicable} 6. An improvement location certificate and/or a preliminary title report 7. Elevations, perspectives or renderings if deemed applicable by the staff of the Community Development Department „t Upon receipt of application, it shai7 be reviewed by the Community Development Department. If the Community Development Department determines that the requirements set forth herein have been met, they sha11 forward the application to the Design Review Board for consideration of whether or 'not the satellite dish antenna meets the requirements set fo•r~,;~ 1~er,ei~~ in Section 1H.54.050 H. D. Satellite dish antennas shall comply with the following requirements: 1. No more than one (1) satellite dish antenna shall be allowed an any lot as delineated on the official Town of Vail zoning map. 2. The temporary use and/or installation of a satellite dish antenna shall be limited to a maximum period of one day. Only three temporary installations shall be allowed per business or residence per year. 3. The maximum height allowed for any satellite dish antenna, when measured from the top of the satellite dish antenna down to existing, or finished grade, whichever is more restrictive, shall not exceed 15 feet. ~~ - Ord 9 198 4. The maximum size of any satellite dish antenna installed for use by a single residence or business shall be limited to 9 feet in dia,~ .,r. Satellite dish antennas serving multi--family dwellings shall be lirr~~'ted to a maximum of 12 feet in diameter. 5. Na advertising, logos or identification shall be allowed on an.y satellite dish antenna. fi. Satellite dish antennas shall comply with the existing setback req~uire- ments of the zone district in which the satellite dish antenna is installed. Satellite dish antennas sh.a71 be prohibited in easements and public right-of-ways. ado portion of a satellite dish antenna or its supporting structure shall encroach into the vertical plane as drawn from an existing easement ar setback line. 7. Issuance of a building periri t from the Community Development Dep~~ ~~,,,;~~~~, shall be required prior to the installation of any satellite dish antenna. 8. Adjacent property owners and owners of dwelling units on the same lot as the applicant shall be.natified of any application for the installation of a satellite dish antenna. Notification procedures sha11 be as outlined in Section 18.66.080 of the Punicipal Code of the Town of Vail. Names and mailing addresses of adjacent property owners and of owners of dwelling units on the same lot as the applicant shall .., ~. be provided to the Community Development Department by the applicar'_. 9. Due to the special aesthetic importance of the core areas of the T~awn, exterior installations of satellite dish antennas in Commercial Cores I and II shall be permitted only if screened by some type of enclosing structure. Said structures regdired to enclose a satellite dish antenna in these areas shall comply with all applicable zoning regulation; and shall be architecturally compatible with the existing structure. A variance may be requested from any of the provisions of this section. The procedures for obtaining a variance shall be set forth in Section 18.62 of the Vail Municipal Code. Y ~ ~~ -4~ Ord 9/1985 ~• Section 2. Section 18.54.050 of the Municipal Code of the Town of Vail is hereby repealed. Section 3. Section 18.54.050 of the Municipal Code of the Town of Vail is hereby amended by the addition of anew subparagraph, 18.54.050 H. entitled "satellite Dish Antennas" to read as follows: 18.54.050 H. Satellite Dish Antennas It is the purpose of these guidelines to ensure that the visibility of a satellite dish antenna from any public right-of-way ar adjacent properties be reduced to the highest degree passible. It shall be the burden of the applicant to demonstrate how the satellite dish antenna installations complies with these guidelines. The guidelines work in concert with regulations outlined in Section 18.58.320 of Uail; Municipal Cade. The following guidelines shall be used by the Design Review Board in evaluating applications for satellite dish antennas: A. A11 wiring and cable related to a satellite dish antenna shall be installed underground. B. The use of mesh satellite dish antennas is highly encouraged because of their ability to be more sensitively integrated on a site ar stru~:ture. k- C. The use of appropriate colars shall be required to provide for a more sensitive installation when integrating a satellite dish antenna onto a site or structure. Color selection fora satellite dish antenna should be made with respect to specific characteristics ~on a site or structure. Unpainted surfaces and satellite dish antennas with reflective surfaces shall nat be allowed. D. Locations of satellite dish antennas shall be made so as to ensure that the satellite dish antenna is screened from view from any public right-of-way ar adjacent property to~the highest degree possible. In addition to effective site planning, screening a satellite dish antenna may be accomplished through the use of land- scaping materials, fencing, existing structures, sub-grade placements or other means that both screen the satellite dish antenna and do not appear unnatural on the site. Ord 9/~ E. Satellite dish antennas on or attached to existing structures shall be permitted provided the satellite dish antenna is architecturally integrated into the structure. Effective use of color shall be required to ensure compatibility between the satellite dish antenna and existing structure. The use of a mesh material shall be strongly encouraged when attempting to integrate a satellite dish antenna onto an existing structure. F. Eandscaping or other site improvements intended to screen a satellite dish antenna proposed on any app]ication shall be completed prior to the issuance of a building permit to install a sa~~lj~te dish antenna. A letter of credit equal to 125% of the costs of installing landscaping or site improvements may be submitted to the Town of 4~ai1 if seasonal weather conditions prohibit the installation of landscaping or site improvements. G. All improvements required by the Design Review Board for the purpose of reducing the visibility of satellite dish antennas shall remain in place so long as the satellite dish antennas remain in place unless permission to alter or'remove said improvements is obtained from the Design Review Board, All satellite dish antennas and all improvements required by the Design Review Board to reduce the visibility of satellite dish antennas shall be adequately maintained and repaired and shall not be allowed to become dilapidated or fall into a state of disrepair. ., ~ ~ 9/85 Section 4. If any part, section, subsection, sentence, clause ar phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ardinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 5. The Town Council hereby finds, determines and declares that this ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 6- The repeal ar the repeal and reenactment of any provisions of the Vail Municipal Code as provided in this ardinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision ar any ordinance previc~;sly repealed or superseded unless expressly~stai;ed herein.
