AN ORDINANCE AMENDING S~CiIUii 1t3.,69.CS2, SPECIAL RESTRICTIOiiS
FOR DEVELOPMENT TN GEOLOGICALLY SENSITIVE AREAS BY THE ADDITION
OF PARAGRAPH H PROVIDING A PROCEDURE TO DEFORM THE PUBLIC WHEN
SITEWSPECTFIC GEOLOGIC INVESTIGATIONS ARE ACCE=PIED BY THE TOWN
COISNCIL SE=TYING FORTH MORE DETAIL THAN EXISTS ON THE OFFICIAL
GEOLOGIC SENSITIVITY MAPS OF THE TOWN OF VAIL; AND PROVIDING
DETAILS IN REGARD THERETO.
WFEEREAS, THE 1~OWN COUNCIL wishes to provide the public with additional site--specific
information than can be found on the official geologic sensitivity maps of the Town o~A
Vail when such information has been accepted as reliable by the Town Council.
NOW, THEREFORE, be it ordained by the Town Council of the Town of Vail, Colorac[o as
fol 1 ows
Section I. Section I8.69.052 Special Restrictions for Development in Geolo~i~ally
Sensitive Areas is hereby amended by the addition of paragraph W to read as follows:
H. In any case where a person wishes to have one of the official maps adopter i3y
this Ordinance amended to notate more detailed site-specific information is available,
the following procedure shall be followed:
1. A written :application shall be filed with the Community Development Depart-
ment requesting such a hearing and providing a~"supporting site-specific geologic investi-
gation.
2. A hearing shall be set on a date not less than thirty (30} days after the
application has been filed nor mare than sixty (60) days to allow fora staff review.
3. If the applicant establishes at the hearing by clear convincing evidence
that the information contained in the site-specific geologic investigation is reliable,
the Town Council shall direct the Community Development Department to keep a copy of
said site--specific investigation on file in the Community Development Department and
available to the general public and shall further direct the Community Development Depart-
ment to notate the appropriate official map adopted by this Ordinance so that it indicates
that said site--specific investigation is on file with the Community Development Depar~ment.
Section 2. Tf any part, section, subsection, sentence, clause, or phrase of
this Ordinance is for any reason held to be invalid, such decision sha]1 not affect the
validity of the remaining portions of this Ordinance; and tine mown Council hereby
declares it would have passed this Ordinance, and each part, section, subsection,
sentence, clause or phrase thereof, regardless of the fact that any one or more parts,
sections, subsections, sentences, clauses or phrases be declared invalid.

Section 3. The Town Council hereby finds, determines and declares that this
Ordinat~ce is necessary and proper for the health, safety and welfare of the Town of
Val] and the inhabitants thereof.
Section 4. The repeal ar the repeal and reenactment of any provision of the
Vail Municipal Code as provided in ;:`;~ Ordinance shall spot ~.,'~,:~.;, ~,;,,~ right <<~hich i,~r
accrued, any duty imposed, any violation that occurred prior to the effective date
hereof, any prosecution commenced, nor any other action or proc~~::~i~,~~~ ~:~ ;:,;,~,;•,~_:~ .. _:.
under or by virtue of the provision repealed ar repealed and reenacted, The repeal of
any provision hereby shall not revive any provision or any ordinance previously repe~:led
or superseded unless expressly stated herein.
INTRODUCED, READ AND APPROVED ON FIRST READING THIS 17th day of
September 1985, and a public hearing shall be held on this ordinance an

Council Chambers of the Vail Municipal Building, Vail, Colorado.
