AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. I7,
SERIES OF 1985, TO CORRECT A TYPOGRAPHICAL ERROR
WHEREAS, the Town Council passed Ordinance Na. 17 making certain amendments in the
Charter of the Town of Vail and providing that said amendments be submitted to a vote
of the people of the Town, and
W€-iEREAS, paragraph 7 of said ordinance contained a typographical error and the lown
Council wishes to correct that error.
NOW, THEREFORE, be it ordained as follows:
Section 1. Paragraph 7 cf Ordinance No. I7, Series of 1985, is hereby amended Uo
read:
7. Section 8.3 - PLANTING COMN[ISSiON, of the Charter of the Town of Vail , Ccl c'. . '~~
is hereby amended to read as follows:
Section 8.3 _ PLANt~iING i;UPyii'~iS3I0N:
There shall be established a seven (7) member planning commission appointed
by the council. Members of the planning commission sha11 be residents of the Town of
Vail and REGISTERED electors. The terms of appointment to the planning commission

shall be for fa~~-¢4~ TWO (2) years on an overlapping basis.
Section 2. In view of the urgency in submitting the Charter amendments of the Town
of Vail to the voters of the Town at general election, this ordinance shall be passed as
an emergency ordinance necessary for the preservation of public property, health, ~i~:lfare,
peace and safety and shall take effect immediately upon final passage.
Section 3. If any part, section, subsection, sentence, clause, or phrase of this
ordinance is for any reason held to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance; and the Town Council hereby declares
it would have-passed this ordinance, and each par-*-~, section, subsection, sentence, clause
or phrase thereof, regardless of the fact that any one or more parts, sections, sub-
sections, sentences, clauses or phrases be declared invalid.
Section 4. The Town Council hereby fiinds, determines and declares that this ordinance
i s necessary and proper for the health, safety and welfare of the ~,.;+ ~ ° '!~u-~ ; and the
inhabitants 'r~ereof.
Section 5. The repeal or the repeal and reenactment of any provision of the Vail
Municipal Cade as provided in this ordinance shall not affect any right which has accrued,
any duty imposed, any violation that occurred prior to the effective date herAof, any
prosecution commenced, nor any other action or proceeding, as commenced undQr ar by
virtue of the provision repealed or repealed and reenacted. The repeal of any provision
hereby shall not revive any provision or any ordinance previously repealed or superseded
unless expressly stated herein.
