HomeMy WebLinkAbout1989-11 Amending Section 3.36.90 of the Vail Municipal Code; Setting Forth Recreational Amenities Tax Rates for New Zone Districts Which Have Been Formed Since the Adoption of the Recreation Amenities Tax Ordinance• ~ i ORDINANCE NO. 11 Series of 1959 AN ORDINANCE AMENDING SECTION 3.36.90 OF THE VAIL MUNICIPAL CODE; SETTING FORTH RECREATIONAL AMENITIES TAX RATES FOR NEW ZONE DISTRICTS WHICH HAVE BEEN FORMED SINCE TH£ ADOPTION OF THE RECREATION AMENITIES TAX ORDINANCE. WHEREAS, new zone districts have been established since the adoption of the Recreational Amenities Tax Ordinance and amendments thereto. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO: Section 1. Section 3.36.040 Tax Rate of Rssessment, of the Municipal Code of the Town of Vail, is hereby amended to read as follows: 3.36.040 Tax Rate of Assessment For buildings constructed in the various zoning districts of the Town, the tax on each building shall be assessed after the filing of an application for a building permit by the building official or other designated Town official in accordance with the following schedule: Zone District Tax Rate per Sq. The rate schedule set forth in this section shall be reviewed annually by the Tawn Council and may be raised or lowered by resolution of the Council after such review, Section 2. Section 3.36.080 Tax Credit Additional is hereby repealed and reenacted as fo11aws: Section 3.36.080 Tax Credit Additional Residential buildings or units which are restricted for use for employee housing shall be entitled to additional tax credits according to the following schedule: Years Restricted Additional Credit 7 - 9 10% 10 - 15 20% 16 - 20 30% 21 - 25 X10% 25 + years 50% Section 3. Section 3.36.090 Tax Credit is hereby repealed and reenacted to read as follows: 3.36,090 lax Credit-Maximum Rate The maximum credit allowed under both Sections 3.36.070 and 3.36.080 shall not exceed fifty percent (5O%) of the tax assessment. Section 4. This Ordinance shall become effective July 1, 1989. Section 5. Tf any part, section, subsection, sentence, clause or phrase of this Ordinance is far any reason held to be invalid, such decision shall nat affect the validity of the remaining portions of this Ordinance; and the Tawn Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. -2- • • • Section b. The Tawn Council hereby finds, determines and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 7. The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town a~' Uail as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under ar by virtue of the provision repealed ar repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. INTRODUCED, READ AND APPROVED ON FIRST READING this 6th day of June 1989, and a public hearing shall be held on this Ordinance on the 6th day of June 1989, at 7:30 p.m. in the Council Chambers of the Vail Municipal Building, Vail, Colorado.
