HomeMy WebLinkAbout1989-31 Amending Various Sections of Chapter 18 of the Vail Municipal Code and Repealing and Reenacting Section 18.58.310 Short Term Rental Accommodation Unit to Provide for Bed and Breakfast Operations Under Certain Provisionsr • s s ORDINANCE NO. 31 Series of 1989 AN ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 18 OF TIIE VAII, MUNICIPAL COllE AND REPEALING AND RE-~ENAC'i'ING SECTION 18.58.310, SIIOR'1' TERM RENTAL ACCOMMODATION UN E'~.' OI' 'I.'IiE MUNICIPAL CODE TO PROVIDE FOR BED AND BREAKFAST OPERATIONS UNDER CERTAIN PROVISIONS AND CIRCUMSTANCES AND TO DEFINE BED AND BREAKFAST AND SE~1'TING FORTH DETAILS IN REGARD THERETO. WT~IEREAS, the Town Council wishes to allow bed and breakfast operations under certain conditions and in certain locations within the Town of Vai].; and WHEREAS, the Tawn Council finds that bed and breakfast operations operated under certain conditions provide high quality and desirable lodging appropriate for a resort community; and WHEREAS, policies within the Town of vail Land Use Flan support the provision of high quality lodging utilizing existing facilities; and WHEREAS, the Planning and Environmental commission has reviewed and recommended changes to the zoning code to accommodate bed and breakfast uses as contained herein. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF `I'liE TOWN OF VAIL, CDLORADO, AS FOLLOWS: Section 1. DEFINITION BED AND BREAI{FAST MEANS A BUSINESS WHICH ACCOMMODATES GUESTS IN A DWELLING UNIT TN WHICH THE BED AND BREAKFAST PROPRIETOR LIVES ON THE PREMISES AND IS IN RESIDENCE DURING THE BED AND BREAIFAST USE. A BED AND BREAKFAST UPERATTON MAY SHORT TERM 3 • s s RENT SEPARATELY UP TO 3 BEDROOMS OR A MAXIMUM SQUARE FOOTAGE OF 900 SQUARE FEET OF THE DWELLING UNIT. BED AND BREAKFAST OPERATIONS SHALL ONLY BE PERMITTED TO ACCOMMODATE A FAMILY AS DEFINED IN SECTION 18.04.1.0. I3. i~OCATION AND CRITERIA BED AND BREAKFASTi' OPERATIONS MAY BE ALLOWED AS A CONDITIONAL USE :LN THOSE ZONE DISTRIC`1'S AS SPECIFIED IN T:T'I'LE iE3 OF `1'IIE VAZL MUNICIPAL CODE. TF PERMITTED AS A CONDITIONAL USE PURSUANT TO CHAPTER TS . 60 OF THIS CODE, BED AND I_iRE[~ICFAS`i' OPERATIONS SMALL BE SUBJECT TO THE FOLLOWING REQUIREMENTS: 1. Section 17. Compliance Tt shall be unlawful for a bed and breakfast operation to do business without a conditional use permit from the Planning and Ez~zvi.ronmental Commission after June 12, 1990 or to operate in violation of any of the provisions of the Vail Municipal Code. Section 18. Discontinuance Any bed and breakfast operation which is discontinued for a period of twelve months, regardless of any intent to resume operation of use, shall not be resumed thereafter, and any future use of the sate or structures thereon sha11 conform with the provisions of this t:~.tle. section 19. The Town Council, the applicant, adjacent property owner or the Town Manager, may appealjcall up to the Town Council for review any decision made by the Planning and Environmental Commission regarding a Conditional Use Permit for Bed and Breakfast as per Section Ig.~o.a~o. Section Z0. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall 5 • • s not affect the validity of the remaining portions of th~.s ordinance; and the Town Council hereby declares it would have passed tl~.is ordinance, acid each part, section, subsect.~on, sezl~tence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. section 21. Section 27. `t'he repeal ar the repeal and re-enactment of any provisions at the Vail Municipal Code as provided in this ordinance shall not af:Cect any right wixich has accrued, any duty imposed, any violation that occurred prior to the effective date Hereof, any prosecution commenced, nor any other action or proceeding as commenced under ar by virtue of the provision repealed or repealed and re-enacted. The repeal of any provision hereby shall. not revive any provision or arty ordinance previously repealed or superseded unless expressly stated hexein.
