ORDINANCE N0. 34 Series of 1990 AN ORDINANCE AMENDING SECTION 5.04.040 B.1. TO PROVIDE FOR BED AND BREAKFASTS TO PAY THE SAME RATE FOR AN ANNUAL BUSINESS LICENSE FEE AND TO BE TREATED TN TPfE SAME MANNER AS A SHORT TERM RENTAL BUSINESS WITHIN THE TOWN OF VAIL; AND SETTING FORTH DETAILS TN REGARD THERETO. WHEREAS, the Town Council believes that it is equitable to treat the short term rental business and the bed and breakfast business in the same manner far the purposes of the Town of Vail annual business license fee. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VATL, COLORADO: 1. Section 5.04.040 B.l. is hereby amended to read as follows: An annual business license fee shall be paid by every person doing business within the Town in accordance with the following schedule: 1) Short term rentals and bed and breakfast operations. Rny person who engages in the short term rental of either accommodation units or dwelling units to one who uses, possesses, or have the right to use or possess such accommodation unit ar dwelling unit, and any person who engages in a bed and breakfast operation as that term is defined in Section 8.58.310 of this Code shall pay a fee as follnws: a) Tf the management office is located in Zone 1, a flat fee of three hundred twenty-five dollars {$325.00) and in addition, a fee of seventeen dollars ($17.00) for each unit located in Zone 1. And an additional fee of twelve dollars and seventy-five cents {$12.75) per unit far each unit located in Zane 2. b) If the management office is located in Zone 2, a flat fee of two hundred forty-three dollars and seventy-five cents ($243.75) and an additional fee of seventeen dollars ($17.00) per unit far each unit located in Zane 1, and twelve dollars and seventy-five cents ($12.75) per unit for each unit located in Zone 2. c) Persons who short term rent no more than two (2) units and people who have a bed and breakfast operation which rents no more than two (2) bedrooms shall be exempt from the provisions of this Chapter. 2. If any part, section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. F _ ~ • • 3. The Town Council hereby finds, determines and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. 4. The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under yr by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 5. All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent herewith are repealed to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaw, order, resolution, or ordinance, or part thereof, heretofore repealed.
