HomeMy WebLinkAbout1992-27 Amending Section 18.57.020 - Employee Housing Units (EHUS) Generally, of the Vail Municipal Code, Paragraph 18.57.020 (C) and (D) to Clarify Restrictions on the Leasing and Sale of Employee Housing Units., ..: ~ • 4 ORDINANCE NO. 27 SERIES 7992 AN ORDINANCE AMENDING SECTION 18.57.024 -EMPLOYEE HOUSING UN1TS {EHUS) GENERALLY, OF THE MUNICIPAL CODE OF THE TOWN OF VAIL, PARAGRAPH 18.57.020 (C) and (D) TO CLAFt1FY RESTRICTIONS ON THE LEASING AND SALE OF EMPLOYEE HOUSING UNITS, AND PARAGRAPH 18.57.U2Q (K}, SECTION 18.57.040 (B) 5, SECTION 18.57.040 B 9, SECTION 1$,57.060 B 13, AND SECTION 18.57.060 B 6 TO CLARIFY THE MEANING. BE lT ORDAINED by the Town Council of the Town of Vail, Colorado: 1. Section 18.57.020 - Paragraph C is hereby amended to read as follows: C. All types of EHUs may be leased, but only to tenants who are full-time employees who work in Eagle County. An EHU shall not be leased for a period less than thirty {34) consecutive days. For the purposes of this Section, a full-time employee is one who works an average of a minimum of thirty {30) hours each week. {a) A Type i EHU may be said, transferred, or conveyed separately from any Single-Family or Two-Family dwelling it may be a part of so long as it meets the conditions set forth in Section 18.57.044(B}5 of this Chapter. (b) A Type ii EHU shall not be sold, transferred, or conveyed separately from the Single-Family or Two-Family dwelling it is located within or attached to. (c) A Type II I EHU may be sold, transferred, or conveyed separately from other dwelling units or employee housing units that may be located on the same lot or within the same building in which the Type Ili EHU is located sa long as it meets the conditions set forth in Section 18.57.060(6)11 of this Chapter. {d) A Type IV EHU shall not be sold, transferred, or conveyed separately from other dwelling units or employee housing units that may be located on the same lot or within the same building En which the Type IV EHU is located. (e) A Type V EHU shall not be sold, transferred, or conveyed separately from the Single-Family dwelling it may be located within or attached to. 2. Section 18.57.020 - Paragraph D is hereby amended to read as foifows: D. Reserved. 3. Section 18.57.024 - Paragraph K is hereby amended to read as follows: t ,yr I, t K. Each EHU shalt have its own entrance. There shall be no interior access from any EHU tc any dwelling unit it may be attached: to. 4. Section 18.57.04085 [s hereby amended to read as follows: (5) A Type I EHU may be rented in compliance with Section 18.57.020 or it may be sold, transferred, or conveyed separately from any Single-Family, orTwo-Family dwelling It may be a part of so long as it meets the following conditions: (a) It must be used by the owner of the EHU as a permanent residence. For the purpose of this paragraph, a permanent residence shall mean the home or place in which one's habitation is fixed and to which one, whenever he or she is absent, has a present intention of returning after a departure or absence therefrom, regardless of the duration of absence. In determining what is a permanent residence, the Tnwn staff shalt take the following circumstances relating to the owner of the residence Ento account: business pursuits, employment, income sources, residence for income or other tax purposes, age, marital status, residence of parents, spouse and children ff any, Incation of personal and real property, and motor vehicle registration. (b) if a Type I EHU is sold, transferred, or conveyed separately from the other un[t in aTwo-Family dweliing it Is a part nf, then both the Type I EHU and the unit to which it is attached shall be subJect to all the provisions set forth in Section i 8.57.020 F,G,H and K of this ordinance. 5. Section 18.57.044 B 9 is hereby amended to read as follows: (9) Thirty days prior to the transfer of a deed far a Type I EHU, the prospective purchaser shall submit an application to the Community Development Department documenting #hat the prospective purchaser meets the cr[teria set forth in Sections 18.57.020 C and 18.57.040 B 5 (a) and shall include an affidavit affirming that he or she meets these oriter[a. 6. Section 18.57.060 B 13 is hereby amended to read as follows: (13) Thirty days prior to the transfer of a deed for a Type I EHU, the prospective purchaser shall submit an application to the Community Development Department documenting that the prospective purchaser meets the criteria set forth in Sections 18.57.020 C and i 8.57.060 B 11 (a} and shall inciude an affidavit affirming that he or she meets these criteria. 7. Section 18.57.060 B 6 is hereby amended to read as follows: (6) It shalt have no more than two (2) bedrooms. 8. If any part, section, subsection, sentence, clause ar phrase of this ordinance is for any reason held to be invalid, such decision shail not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and z ~' .~ each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. 9. The Town Council hereby finds, determines, and declares that this ordinance is necessary and proper for the health, safety, and welfare of the Tnwn of Vail and the inhabitants thereof. 10. The repeal or the repeal and reenactment of any provision of the Municipal Code of the Town of Vail as provided in this ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under ar by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shalt not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. 3 ,y •y . . 1 i , All bylaws, orders, resolutions, and ordinances, or parts thereof, inconsistent ' herewith are repeaied to the extent only of such inconsistency. This repealer shall not be construed to revise any bylaws order, resolution, or ordinance, or part thereof, theretofore repealed.
