HomeMy WebLinkAbout2011-11 Comcast Easement at West Vail Fire Station ORDINANCE NO. 11 Series of 2011 AN ORDINANCE AUTHORIZING A TEN FOOT WIDE UTILITY EASEMENT ALONG THE SHARED PROPERTY LINE BETWEEN PARCEL A AND PARCEL B, A RESUBDIVISION OF TRACT D, A RESUBDIVISION OF VAIL DAS SCHONE FILING NO.1, A RESUBDIVISION OF PARCELS A & B, TOWN OF VAIL, COUNTY OF EAGLE, STATE OF COLORADO; AND SETTING FORTH DETAILS IN REGARD THERETO. WHEREAS, the Town of Vail (the "Town "), in the County of Eagle and State of Colorado is a home rule municipal corporation duly organized and existing under the laws of the State of Colorado and the Town Charter (the "Charter "); WHEREAS, the members of the Town Council of the Town (the "Council ") have been duly elected and qualified; WHEREAS, the Town of Vail is the owner of record of Parcel A and Parcel B, a resubdivision of Tract D, a resubdivision of Vail Das Schone Filing No.1, a resubdivision of Parcels A & B, Town of Vail, County of Eagle, State of Colorado; WHEREAS, the Charter of the Town of Vail enables the Vail Town Council to dedicate town -owned land for demonstrated public purposes; WHEREAS, as a result of the completion of the new West Vail Fire Station #3 a ten foot wide utility easement (the "Easement ") is needed along the entire length of the shared property line between Parcel A and Parcel B, as shown in the attached Exhibit A ; WHEREAS, at this time Comcast Cable desires to bury a cable line within the area of the Easement to serve the needs of the fire station and the properties in the vicinity; WHEREAS, the Town desires to dedicate a ten foot wide utility easement along the shared property line; WHEREAS, the Council considers it in the best interest of the public health, safety and welfare of the Town of Vail to dedicate the Easement as shown in the attached Exhibit A . NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF VAIL, COLORADO, THAT: Section 1. The Council hereby approves and authorizes the dedication a ten foot wide utility easement along the entire length of the common property line between Parcel A and Parcel B, as shown in the attached Exhibit A . Section 2. If any part, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not effect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed this ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. Section 4. The Council hereby finds, determines and declares that this Ordinance is necessary and proper for the health, safety and welfare of the Town of Vail and the inhabitants thereof. INTRODUCED, READ ON FIRST READING, APPROVED, AND ORDERED PUBLISHED ONCE IN FULL ON FIRST READING this 19 day of April, 2011, and a public hearing for second reading of this Ordinance set for the 3` day of May, 2011, at 6:00 P.M. in the SI mbers of the Vail Municipal Building, Vail, Colorado.
