As I understand, you are proposing to relocate the existing Coldwell Banker offices from 286 Bridge Street to this new location, and also to partner with Futurian Systems to sell products and home solutions. The property at 227 Bridge Street, Unit #D, is zoned Commercial Core 1, which allows for retail uses, restaurants, lodges, and employee housing units as Permitted Uses on the first floor or street level. The space you are proposing to use is considered first floor or street level. Professional offices, business offices and studios (including real estate offices) are prohibited on this level. Futurian Systems, which is defined as electronic sales in the Vail Town Code, would be a Conditional Use on the first floor or street level and would require a public hearing with the Planning and Environmental Commission. (See Sec. 12-7B-3, Vail Town Code) Following are the Vail Town Code definitions of Business Office, Professional Office, and Electronics Sales: OFFICE, BUSINESS: An office for the conduct of general business and service activities, such as offices of real estate or insurance agents, brokers, secretarial or stenographic services, or offices for general business activities and transactions, where storage, sale, or display of merchandise on the premises occupies less than ten percent (10%) of the floor area. OFFICE, PROFESSIONAL: An office for the practice of a profession, such as offices of physicians, dentists, lawyers, architects, engineers, musicians, teachers, accountants, and others who through training are qualified to perform services of a professional nature, where storage, sale, or display of merchandise on the premises occupies less than ten percent (10%) of the floor area. SHOPS, ELECTRONICS SALES AND REPAIR: A facility where home electronics are sold and/or repaired on the premises. In your letter you also mentioned digital marketing for Town of Vail happenings (window displays). I want you to know that the Vail Town Code prohibits signs and window displays with the following features (including televisions and computer screens): • the illusion of movement; • flash, pulse, move, rotate, scintillate, blink, flicker, or vary in intensity and/or color; • gas filled, illuminated or fiber optic sign that is less than four feet (4') from a window; (See Sec. 11-9-2, Vail Town Code) If you disagree with this staff interpretation of the Code you may appeal this decision to the Planning and Environmental Commission, per Section 12-3-3B, Appeal of Administrative Actions, Vail Town Code. Other options include seeking a rezoning of the property, or seeking to amend the text of the Vail Town Code. In my opinion, a rezoning and a text amendment are extremely unlikely and would be contrary to the intended purposes of the Commercial Core 1 zone district, which includes maintaining a predominantly pedestrian environment.
