The purchaser, Mr. George Tompras, has been prevented from closing on the project because of concerns voiced by the Town of Vail related to ownership of this parking space by an individual who does not own other property in the Village Inn Plaza Condominium. As I have advised you previously, parking Condominium #777 hras been owned by persons or entities who have not owned property in the Village Inn Plaza Condominium since it was conveyed by First Interstate Bank of Denver in 1999. Based upon a conversation with George, we understand that an enplanation of the chain of title may be helpful in permitting you to understand this history, and that is the purpose of this letter and the attached material. The chain of title, since the time of ownership by First Interstate Bank of Denver, is as follows (the dating information being the date of the instrument and the date of rcordation, respectively): 11 Oct 1988/05 May 1989 - Book 505, Page 648 - First Interstate Bank of Denver to John Sevo - Sevo later owned a condominium in Avon, but nothing was discovered under his name in Vail in a search of the Clerk and Recorder's records during this period - no documentary fee. 22May 1995/30 May 1995 - Book 668, Page 175 - Sevo to Covered Bridge Building Ltd. - the parking space was apparently purchased by the developers ofthe Covered Bridge Pmthouse in order to make that property more marketable - Documentary fee of $4.50, indicating consideration of $45,000.00. 21 October 1996/24 October 1996 - Book 709, Page zt48 - Covered Bridge Building, Ltd. to Serendipity, Ltd. - initial sale of the Covered Bridge Building penthouse, together withVillage Inn Plaza Condominium Unit 717 - Documentary fee of $295.00, indicating consideration of $2,950,000.00, supported by the recitation of consideration in the deed. L5 July 1997/24 Jlly 1997 - Book 732, Page 832 - Serendipity, Ltd. to Vialta Investments - subsequent sale of the Covered Bridge Building penthouse, togetherwith Village Inn Plaza Condominium Unit 717 - Documentary fee of $323.50, indicating consideration of $3,235,000.00, supported by the recitation of consideration in the deed. Undated deed./22 September 2000 - Reception739760 -Vidta Investments to Premier Real Estate - subsequent sale of the Covered Bridge Building penthouse, together with Village Inn Plaza Condominium Ufit7'1,7 - No documentary fee paid. 20 September 2OOO/22 September 2000 - Reception 739760 - Premier Real Estate to Gustafson - subsequent sale of the Covered Bridge Building penthouse, together wittt Village Inn Plaza Condorrinium Urnt 717 - Documentary fee of $430.00, indicating consideration of $4,300,000.00, supported by the recitation of consideration in the deed. 21 April 2OA4 - Reception 874581 - Gustafson to Charles David Luther (the current owner) - subsequent sale of the Covered Bridge Building penthouse, together with Village Inn Plaza Condominium Unit 717 - Documentary fee of $460.00, indicating consideration of $4,600,000.00, supported by the recitation of consideration in the deed. In addition to this drain of title, we have discovered at least trflo other early conveyances of Village Inn Plaza Condominium parking spaces, by the developer, which appe:u to have occurred to individuals or an entity who or which was not an owner of other property in the project. These tr:rnsaction are as follows: 01 April 7989/20 April 1989 - Book 504, Page 530 - Vail Village Inn, Inc. to Lloyds - WI parking condominium #739 - Documentary fee of $ 1 .40, indicating consideration of $14,000.00. 29 June l99O/03 July 1990 - Book 532,Page 879 - Vail Village Inn, Inc., to BSC of Vail Co LLP - #7O1,763,765 - Documentary fee of $4.50, indicating consideration of $45,000.00, supported by the recitation of consideration in the deed. No evidence has been fond that either lJoyds or BSC of Vail Col. LLP owned any other property in the Village Inn Plaza at the time of the conveyance of these parking spaces. At le:ut two observations should be made based on the foregoing and attached information. First, Condominium #717 appears to have been owned by entities or individuals who have not owned property in the Village Inn Condominium for almost twenty years. There have been seven conveyances of the properry :rmong entities or individuals who have treated the property as their own without intervention by the Town or any third parry. Secondly, it seems apparent that it was the practice of the developer to deed condominium parking spaces to individuals or entities who did not own property in the Village Inn Plaza. While we iue uncertain who or what entity is now raising objections to the convey:rnce of parking spaces already owned by non-Wl owners to other non-Wl owners, if the objection is coming from someone representing Vail Village Inn, Inc., then that objection is coming from someone who has historically engaged in that practice. Based upon this information, confirmation would be appreciated that the convey:rnce of Village Inn Plaza Condominium #717 fuomthe current owner, Charles David Luther, to George Tompras or his assignee, both being non-owners ofVillage Inn Plaza property, is valid, and neither the conveyance nor the use ofthat property by non-owners will be drallenged by the Town of Vail.
