In the event the person so notified does not comply with the notice within tlre period of time herein specified, the Dircctor of Public Works, or other authorized agent, may cause any such sand, gravei. rocks, mud dirt, snow, ice, debris or any other material to bc rcrnoved from any strect or alley attlre expense ofthe notified. C. Exceptions: The provisions of subsection A hereof shall not be applicable: I . Within the immediate area of any corstruction, maintenancc or repair proj ect of any street or alley or of any water main, sewer main, electricity line, gas line, telephone line or any appurtenance tlereto;2. To deposits of sand, dirt or materials necessary for the protection of the public safety: and 3 . To public areas designated for the dumping or depositi4g of said materials. D. Summons; Penalty: As an alternative to the notice for remoial fiovided in subsection B above, any person who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of the Town for sardviplations, and upon being found guilty of a violation hereunder be punished as provided ii becudrr,lt -4- I ofthis code. Kathy Langenwalter stated that if you looked at the proposed nine hundred burial space capacity of this cemetery plan over a one hundred year period, that this would average out to only nine burials ayea(. She said that she wondered whether this would be adequate to meet the community's demand for burial spaces. She suggested that the number of niches be increiised. This proposal includes an approximate 18 square foot expansion to the Gotthelf's JEwelers retiail space, located on the south side of the Lodge at Vail Building on East Gore Greek Drive. Under the redevelopment proposal, Gotthelf Jewdlers would expand their retail spqce by adding an 18 square loot bay window to be used for the dFplay oil lesrelry (see attached rendering). II. ZONING CONSIDERATIONS The following summarizes the zoning statistics for this exterior alteration requ$t: Zone District: Lot Area: Parking: Site Coverage: No change in site coverage will occur as a result of this bay window additibn because the proposed expansion is already covered by the second floor of the building above. CommercialCore | (CCl) 20,000 square teet The staff has determined that the parking requirement associated with the proposed addition is 0.06 of a parking space. Because this property ls located in the Gommercial Gore I zone district, which does not allow for the provision of on-site parking, $e developer will be required to pay into the Town's pafting pay-in{ieu fund. According to Section 18.52.160 (8,5) of the Municipal Codg, 'ths parking fee is $8,000.00 per space. The Commercial Core I District is intended to ensure adequate light, air, open space, and other amenities appropriate to the permitted types of buildings and uses. The district regulations in accordanca with the Vail Village Urban Design Guide Plan and Design Consjderations prescribe site dwelopment standards hat are intended to ensure the maintgnance and proservation of the tightly' clustered arrangements of buildings fronting on pddestrian ways and pubtic greenways, and to Ensure continuation ol he building scale and architectural qualities that distinguish the Village.' It is the straff's opinion that the proposed change to the Gothelf Jewelers relail space, would be in compliance with the Purpose Section of the Commercial Core I Zone District as stated above. We also believe that the addition will not negalively Etfect the scale of the building nor detract from the overall appearance of the building as viewed from the pedestrian areas adjacent to the building. IV. REVIEW CRITERIA FOR THIS PROPOSAL The Vail Village Urban Design Guide Plan includes three elements which establish the review criteria for this application. The first of these is referred to as lhe Guide Plan which includes a number of sub-area concepts, many of which identify potential areas for future development and other improvemenls. Secondly, the Urban Design Considerations express the large scale, land use planning and design considerations, and finally the architectural/landscape considerations, which will be reviewecl by the Deslgn Review Board, establish he criteria for evaluating detailed design consideralions of a proposal. The Vail Village Master Plan and the Vail Streetscap€ Plan address specilic goals pertaining to the enhancement of the walking experience throughout the Village. In addition, traditional zoning considerations are also a factor in this proposal. V. COMPLIANCE WITH THE URBAN DESIGN GUIDE PLAN FOR VAIL VILLAGE There are no specific sub-area conc€pts relevant to this proposal. VI. COMPUANCE WITH THE URBAN DESIGN CONSIDERATIONS FOR VAIL VILLAGE The following design considerations are a crltical elernent of he Urban Design Plan. They identify the key physical cfiaracteristics of the Village and provide the tools to ensure that new development is consistent wift the established character. The design considerations include t' the following: A. Pedestrianizatlon: The proposed bay window will have limited, if any, impacts on the pedestrian tratfic flow along the sidewalk adjacent to East Gore Greek Drive. The bay window has been limited to an 18 inch extension from thE exterior facE of the building which matches other bay windo{,s along the north side of the Lodge at Vail Building. The bay window will add interest to the existing pedestrian area with an increase in window area transparency and increased visibility into the retail shop. B. Vehicular Peneratlon: Vehicular penetration and circulation wlll remain unchanged as a result of this proposal. C. Streetscape Framework: The Urban Design Considerations for Vail Village identify the development of in-fill commercial store fronts along pedestrian conidorc as one m€thod of improving the pedestrian experience in the Village. The staff believes that the addition of a bay window to this area will improve the pedestrian €xperience by converting an othemise unused space into viable commercial area. In addition, the increased transparency of the shop frontage will arld visual interest to East Gore Creek Drive. D. Street Enclosure: Due to the location of the proposed building alteration, beneath a third story cantilevered area, and the relatively small size of the proposed remodel, it is staff's opinion that the proposed addition will not have a negauve impact on street enclosure. E. Street Edge: Stafl believes that the addition ol a bay wlndow to Gotthelf Jsirrelers will have no impact on the street edge along East Gore Creek Drive. F. Building Height . Building height will be unaffected as a result of tris proposal. G. Vaeurs and Focal PolnF: The proposed remodeldoes not atfect any of he Town's adopted vievtr conidors. In addition, the remodel will have no impact on the lin+of-sight lrom either the top or the bottom of East Gore Creek Drive. H. Servlce and Delivery: The proposed expansion will not affect cunEnt service and dellvery pattems. l. Sun/Shade: There will be no increase in shadow pattems as a result ol this addition as it is located within the existing shade pattems of th6 building. J. Architecturaubndscape Conslderations: These design considerations are gpically the purview of the Design Re\riew Board. Staff feels that the proposed materials, colors and architectural stylo of tho proposed bay window addition are compatible with the sunounding retail shops. The proposed addition will have no effect on existing landscaped areas on the property. Vll.
