R~~~R~ER . - _~ Series of Z98fi N>~~ ! ~ ~ z~ PM'~~ 1: AN ORDINANCE AfNEfVDING ORDINANCE NO. 8, SERIES OF 1986, TO PROVIDE FOR A CORRECTION OF THE LEGAE_ DESCRTPTiON OF THE TERRITORY ANNE}{ED IN SAID ORDINANCE NO. 8, AND SETTING FORTH DETATI.S IN REGARD THERETO. WHEREAS, Ordinance No. 8, Series of 7.986, annexed into the Town of Vail an area ~~~~ ~~ commonly known as the Solar Crest Condominiums; and WHEREAS, it has come to the Town's attention that an error was made in the annexation map and legal description of said area; and WHEREAS, the Town Council wishes to correct said legal description and file an appropriate amended annexation map with the County of Eag]e. NOW, THEREFORE, BE IT ORDAINED by the Town Council oi' the Town of Vail, Colorado, as follows: Section 1. Ordinance No. 8, Series of 3.986, is hereby amended so that the area set forth in Exhibit A is deleted and the annexation map and legal description which is attached hereto is substituted therefor. Section 2. The Town Clerk is hereby authorized to file an amended and corrected annexation plat with the County Clerk and Recorder's Office as required by the Statutes of the State of Colorado. Section 3. After the effective date of this Ordinance, the Planning and Environmental Commission is hereby directed to set a date for a public hearing to consider the zone districts to be imposed an the annexed area in accordance with the requirements of Chapter 18.68 of the Municipal Code of the Town of Vail and said zoning shall be imposed upon the annexed area within ninety (90) days as provided far by the Statutes of the State of Colorado. Section 4. If any part, section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance; and the Tawn Council hereby declares it would have passed this Ordinance, and each part, section, subsection, sentence, clause or phrase thereof, regardless of the fact that an,y one or more parts, sections, subsections, sentences, clauses or phrases be declared invalid. ,: ~„ Section 5. The Town Council hereby finds, determines and declares that this Ordinance is necessary and proper far the health, safety and welfare of the Town of Vail and the inhabitants thereof. Section 6. The repeal ar the repeal and reenactment of any provision of the Vaii Municipal Code as provided in this Ordinance shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceedings as commenced under or by virtue of the provision repealed or repealed and reenacted. The repeal of any provision hereby shall not revive any provision or any ordinance previously repealed or superseded unless expressly stated herein. INTRODUCED, READ AND APPROVED ON FIRST READING THIS 21st day of October 1986, and a public hearing shall be held on this Ordinance on the 21st day of October , 1985 at 7.30 p.m. in the Council Chambers of the Vail Municipal Building, Vail, Colorado.
